THE case against an Isle of Wight man accused of a string of offences — from motoring to drugs — has been discontinued.
Brian James Bailey, of Monkton Street, Ryde, had charges of driving without insurance and fraudulent use of a registration mark or registration document, on October 13, and obstructing or resisting a police officer in the execution of his/her duty and possessing cannabis, on October 14, formally dropped by the Crown Prosecution Service.
"There is not enough evidence to provide a realistic prospect of conviction. It is anticipated further evidence may become available in the near future, as a result of which, the prosecution may well start again," a senior Crown prosecutor said in a letter read by judge, Timothy Mousley, at the Isle of Wight Crown Court today (Friday).
Subsequently, the judge formally discontinued the case — but warned the 45-year-old it may be reopened if fresh evidence comes to light.
Bailey had been jailed for three weeks by a judge, sitting at the Isle of Wight Magistrates' Court on November 15, for his deliberate refusal to engage with the court process.

On that occasion, Judge Anthony Callaway called for Bailey to be forcibly removed from the dock, so the case could proceed in his absence.
However he was released on bail later that week when the case was re-opened.
