A NEWPORT sex offender found with unregistered devices­ ­— including an Xbox with no internet history ­— has been spared jail.

Richard Warne, 56, of Carisbrooke Road, appeared before the Isle of Wight Magistrates' Court on Monday.

He admitted three counts of breaching a sexual harm prevention order on January 8.

The court heard from prosecutor, Ann Smout, how on November 29, 2017, at the Isle of Wight Crown Court, Warne had been made subject to an indefinite sexual harm prevention order.

Mrs Smout said, when police visited his home address unannounced, they inspected all of his internet-enabled devices.

She said Warne handed officers a new device ­— an iPhone ­— which he said had not been registered due to the lockdown.

Text messages on the device dated back four weeks, but nothing of concern was found on either of his mobile phones.

Another device was presented to police ­— an Xbox 360 which Warne also hadn't registered. The court heard how Warne had used to console to watch pornography.

In interview, Warne fully admitted the breaches and told police he did not realise he was not allowed to delete his internet history.

He said had had not been doing anything illegal and had deleted it without thinking.

Oscar Vincent, defending, said both devices had been obtained in December and Warne had had them for a short duration.

He said when Warne was subject to police assessment, he did not attempt to hide the devices and volunteered the information freely.

Mr Vincent said Warne had pleaded guilty at the earliest opportunity and made full and frank admissions. He said Warne had meant to register the devices but had forgotten.

Magistrates told Warne he had shown deception, having been fully aware of the requirements and warned on a number of occasions.

He was sentenced to a six-month jail term, suspended for 24 months, to include 30 rehabilitation days.

Warne was also ordered to pay costs of £85 and a £128 surcharge.
